1. AGREEMENT.
This User Account Terms and Conditions of Use agreement (these "Terms") is made by and between Current AI, LLC ("Current AI"), a State of North Carolina limited liability company, with offices at 1711 Commonwealth Ave., #217 Charlotte, 28205, and you the user ("you" or "User"). These Terms specify the terms and conditions for access to and use of the Currentmobile application (the "App"), and all related features, content, and services provided by Current AI (collectively, the "Services").
Effective Date and Version. These Terms are effective as of 3/26/2026 and constitute Version 1.0. The most current version of these Terms, which supersedes all previous versions, can be reviewed at gogetcurrent.io/terms.
Acceptance of Terms. BY CLICKING THE "I AGREE" OR "ACCEPT" BUTTON, BY CREATING AN ACCOUNT, BY DOWNLOADING OR INSTALLING THE APP, OR BY ACCESSING, VISITING, BROWSING, USING, OR ATTEMPTING TO INTERACT WITH ANY PART OF THE SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
Incorporation of Related Documents. Your use of the Services is also governed by our Privacy Notice, available at gogetcurrent.io/privacy, and our End User License Agreement ("EULA"), available at gogetcurrent.io/eula. These documents are incorporated by reference into these Terms. In addition, when using the Services, you shall be subject to any posted policies, guidelines, or rules applicable to specific features or functionality.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
The App and the Services are intended for adults. The Services are not intended for, and we do not knowingly collect Personal Information from, children under the age of eighteen (18). If you reside outside the United States, the Services are not intended for persons under the age of majority in your jurisdiction. By using the Services, you represent and warrant that:
(a) You are at least eighteen (18) years of age, or, if you reside outside the United States, you are at least the age of majority in your jurisdiction;
(b) You have the right, authority, and capacity to enter into these Terms and to abide by all ofthe terms and conditions of these Terms;
(c) All information you submit is truthful and accurate;
(d) You will maintain the accuracy of such information; and
(e) Your use of the Services does not violate any applicable law or regulation.
Geographic Eligibility. The Services are intended for use within the United States. If you access the Services from outside the United States, you are responsible for compliance with all applicable local laws and regulations. Certain features, including promotions and business capacity information, may be limited to specific geographic areas within the United States.
User Account Security. You are responsible for maintaining the confidentiality and security of the credentials of the account created by a User to access the Services and their features through the App (your “User Account”), including your username, password, and any other authentication information. You agree to: (a) create a strong password that is unique to your User Account; (b) not share your password or account credentials with any third party; (c) immediately notify Current AI at support@gogetcurrent.io if you become aware of any unauthorized use of your User Account or any other breach of security; and (d) ensure that you log out of your User Account at the end of each session when using a shared or public device. Current AI is not liable for any loss or damage arising from your failure to comply with these account security requirements.
Accuracy of Registration Information. You represent and warrant that all information you provide during the account registration process is true, accurate, current, and complete. You agree to promptly update your registration information to maintain its accuracy and completeness. Current AI reserves the right to suspend or terminate your User Account if any information provided during registration or thereafter proves to be inaccurate, false, outdated, or incomplete.
Single Account Restriction. You may create and maintain only one (1) User Account. Creating multiple User Accounts is prohibited, and Current AI reserves the right to terminate any duplicate accounts.
Account Transfers. Your User Account is personal to you. You may not transfer, sell, assign, or otherwise convey your User Account to any other person or entity. Any attempted transfer of your User Account in violation of this provision shall be null and void.
Verification Requirements. Current AI may require you to verify your identity, contact information, or other account details before enabling access to certain features of the Services. You agree to cooperate with any verification requests and to provide accurate information as requested. Failure to complete verification may result in the suspension or limitation of your access to certain features.
3. USER ACCOUNT TYPES AND TIERS
The Services are offered under a freemium model with both free and paid subscription tiers.
Free Tier. Users who create a User Account without purchasing a paid subscription ("Free TierUsers") will have access to basic features of the Services, including: (a) viewing local business listings and information; (b) accessing limited real-time business capacity information; (c) viewing third-party promotions; and (d) basic user profile functionality. Free Tier Users may be subject to limitations on certain features, including the frequency of searches, the number of businesses that can be saved or favorited, and access to premium content.
Paid Tier. Users who purchase a paid subscription ("Paid Tier Users" or "Premium Users") will have access to enhanced features, including: (a) unlimited access to real-time business capacity information; (b) exclusive app-specific promotions; (c) enhanced AI chatbot functionality; (d) advanced user profile features and personalization; (e) priority customer support; and (f) ad-free or ad-reduced experience. The specific features available to Paid Tier Users will be described on the Services at the time of subscription purchase.
Trial Periods. Current AI may, from time to time, offer trial periods for paid subscription features. Trial periods are subject to the terms and conditions specified at the time of enrollment. At the end of a trial period, your subscription will automatically convert to a paid subscription unless you cancel prior to the end of the trial period.
Tier Upgrades and Downgrades. You may upgrade from a Free Tier to a Paid Tier at any time by purchasing a subscription through the App. If you downgrade from a Paid Tier to a Free Tier, your downgrade will take effect at the end of your current billing period, and you will retain access to Paid Tier features until that time. Upon downgrade, certain data or content associated with Paid Tier features may no longer be accessible.
Data Portability. If you downgrade your subscription tier or terminate your account, you may request a copy of your user-provided profile information in a commonly used, machine-readable format. Requests must be submitted in accordance with the procedures described in our Privacy Notice. Certain data, including AI-generated inferences and aggregated usage data, may not be available for export.
4. SUBSCRIPTION AND PAYMENT TERMS
Subscription Pricing and Billing Cycles. Paid subscriptions are available on a monthly or annual basis at the prices specified in the App at the time of purchase. Subscription fees are charged in advance at the beginning of each billing cycle.
Business Subscriptions. Business Users may be offered enterprise subscription tiers with additional features, increased user limits, or other functionality designed for hospitality operations. Enterprise subscriptions may be billed directly by Current AI outside of the App Store payment system, subject to separate invoicing and payment terms.
Automatic Renewal – IMPORTANT NOTICE. YOUR PAID SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL YOUR SUBSCRIPTION BEFORE THE RENEWAL DATE. By purchasing a paid subscription, you authorize Current AI to charge your designated Payment Method for the then-current subscription fee at the beginning of each renewal period.
California Automatic Renewal Law Compliance. If you are a California resident, the following additional disclosures apply pursuant to California Business and Professions Code Section 17602: (a) your subscription will continue and your Payment Method will be charged on a recurring basis until you cancel; (b) the cancellation policy and procedures are described below; (c) you may cancel your subscription at any time by accessing your account settings within the App or by contacting us at support@gogetcurrent.io; and (d) you will receive a confirmation of your automatic renewal terms at the time of your initial subscription and before each renewal.
State Automatic Renewal Law Compliance. Current AI complies with applicable state automatic renewal laws, including those in California, New York, Illinois, Virginia, and other states. If you are a resident of a state with automatic renewal disclosure requirements, you will receive the required disclosures and consent mechanisms at the time of purchase.
Payment Methods. Current AI accepts the following payment methods for paid subscriptions purchased through the App: (a) valid credit cards (Visa, MasterCard, American Express, Discover); (b) valid debit cards; (c) App Store payment methods (Apple Pay, Google Pay); and (d) other payment methods as may be made available through the App from time to time. By providing a payment method, you represent and warrant that you are authorized to use that payment method and authorize Current AI to charge your payment method for all fees incurred in connection with your subscription.
Currency and Applicable Taxes. All subscription fees are stated and payable in United States Dollars (USD). Subscription fees do not include, and you are solely responsible for, any applicable federal, state, or local sales, use, value-added, or other taxes, duties, or governmental assessments of any nature ("Taxes"), except for taxes based on Current AI's net income. Current AI may collect such Taxes where required by applicable law. If you are exempt from payment of such Taxes, you must provide Current AI with a valid tax exemption certificate authorized by the appropriate taxing authority.
Price Changes. Current AI reserves the right to change subscription prices at any time. If you have an active paid subscription, Current AI will provide you with notice of any price change at least thirty (30) days prior to the effective date of the change. Your continued use of the Services after the price change takes effect constitutes your acceptance of the new price. If you do not agree to the price change, you may cancel your subscription before the change takes effect.
Failed Payment Procedures. If your Payment Method is declined or otherwise fails, Current AImay attempt to charge your Payment Method again or may attempt to charge an alternate Payment Method on file. If payment cannot be successfully processed after reasonable attempts, Current AI may suspend or terminate your access to Paid Tier features until a valid Payment Method is provided.
Refund Policy. Except as otherwise required by applicable law, all subscription fees are non-refundable. If you cancel your subscription, you will retain access to Paid Tier features through the end of your current billing period, but no refund or prorated credit will be issued for the unused portion of that period. Notwithstanding any other provision of these Terms, refunds for purchases made through the App Store are governed by the applicable App Store's refund policy. To request a refund for an App Store purchase, you must contact the App Store directly. Current AI cannot issue refunds for purchases processed through the App Store.
Cancellation Rights and Procedures. You may cancel your paid subscription at any time by: (a) accessing the subscription management settings within the App; (b) following the cancellation instructions provided in your App Store account settings (Apple App Store or Google Play Store); or (c) contacting Current AI at support@gogetcurrent.io. Cancellation will be effective at the end of your current billing period.
App Store Purchases. Purchases made through the App, including subscriptions, premium features, and virtual items, are processed through the applicable App Store's payment system. All such transactions are subject to the App Store Terms, including the App Store's payment, refund, and cancellation policies. Current AI does not process or have access to your payment card information for purchases made through the App Store.
5. USER PROFILE AND INFORMATION
The Services allow you to create and maintain a user profile that may include information you provide directly and information derived from your use of the Services.
User-Provided Information. You may provide information for your user profile, including your name, preferences, interests, and other details. You are solely responsible for the accuracy of the information you provide.
Activity History and Profile Enhancement. Current AI may use your activity history within the Services, including your searches, business views, saved favorites, and app interactions, to enhance and personalize your user profile and experience. This information may be used to provide you with personalized recommendations, relevant local business suggestions, and targeted promotions.
AI Chatbot Interaction Data and Automated Profile Modifications. The Services include an AI-powered chatbot feature that interacts with you and may update your user profile based on your conversations. By using the AI chatbot feature, you acknowledge and agree that: (a) your chat conversations will be collected and analyzed; (b) the AI chatbot may make inferences about your preferences, interests, and intent based on your conversations; (c) your user profile may be automatically updated based on these inferences; and (d) these automated profile modifications are intended to improve your experience with the Services.
User Rights to Review and Modify Profile Information. You may review and modify your user profile information at any time through the profile settings in the App. You may also request that Current AI delete specific inferred data or profile modifications by contacting us at privacy@gogetcurrent.io. Certain profile information may be required for the operation of the Services and cannot be deleted while your account remains active.
Profile Visibility Settings. You may control the visibility of certain aspects of your user profile through the privacy settings in the App. Some profile information may be visible to Current AIand its service providers regardless of your visibility settings.
Sensitive Personal Information. Certain information collected through the Services may constitute "sensitive personal information" under applicable state privacy laws, including your precise geolocation data. For information about how we collect, use, and disclose sensitive personal information, and your rights with respect to such information, please see our Privacy Notice at gogetcurrent.io/privacy.
Right to Limit Use of Sensitive Personal Information. If you are a resident of California or another state with applicable privacy laws, you may have the right to limit our use and disclosure of your sensitive personal information. To exercise this right, please follow the procedures set forth in our Privacy Notice or contact us at privacy@gogetcurrent.io.
Inferred Data and Profiling Disclosures. Current AI may create inferred data about you based on your use of the Services, including preferences, interests, and characteristics derived from your activity, interactions, and AI chatbot conversations. For more information about how we use inferred data and your rights regarding profiling, please see our Privacy Notice.
6. BUSINESS OWNER “CLAIM” FUNCTIONALITY
The Services include functionality that allows business owners to "claim" their business listings within the App. This Section governs the terms applicable to business owners who claim their listings.
Eligibility. To claim a business listing, you must: (a) be an owner, authorized officer, partner, or authorized representative of the business; (b) have the legal authority to bind the business to these Terms; (c) be at least eighteen (18) years of age; and (d) complete the verification process described below.
Verification and Authentication. Current AI will require you to complete a verification process to confirm your authority to claim the business listing. The verification process may include: (a) providing documentation demonstrating your ownership or authority; (b) responding to verification communications sent to publicly listed contact information for the business; (c) providing government-issued identification; or (d) other verification methods as determined by Current AI in its sole discretion. Current AI reserves the right to deny or revoke a business claim if verification cannot be satisfactorily completed.
Representations and Warranties. By claiming a business listing, you represent and warrant that: (a) you are the owner or an authorized representative of the business with authority to claim the listing; (b) all information you provide in connection with the claim is true, accurate, and complete; (c) you have the legal right to bind the business to these Terms; and (d) your claim does not violate any applicable laws or the rights of any third party.
Rights and Responsibilities of Verified Business Owners. Upon successful verification, you will have the ability to: (a) update and manage the business information displayed in the App, including business hours, contact information, and descriptions; (b) respond to user reviews and inquiries; (c) post promotions and special offers (subject to any applicable promotion guidelines); (d) access analytics and insights regarding user engagement with your business listing; and (e) manage real-time capacity information displayed for your business. You remain solely responsible for the accuracy of all information you provide regarding your business.
Content Management Permissions. As a verified business owner, you may add, edit, or remove certain content associated with your business listing, subject to Current AI's content guidelines and moderation policies. Current AI reserves the right to remove or modify any content that violates these Terms or our content guidelines.
Dispute Resolution for Contested Claims. If multiple parties claim the same business listing, Current AI will investigate and resolve the dispute in its sole discretion. Current AI may request additional documentation from claimants and may suspend or limit access to the business listing during the investigation. Current AI's determination shall be final and binding.
Removal or Transfer of Claimed Business Status. Current AI may remove your claimed business status if: (a) you are no longer affiliated with the business; (b) the business ceases operations; (c) you violate these Terms; (d) you provide false or misleading information; or (e) Current AI determines, in its sole discretion, that removal is necessary. You may voluntarily relinquish your claimed business status at any time by contacting support@gogetcurrent.io.
Liability for Inaccurate Business Information. You are solely responsible for the accuracy of all business information you provide through the claimed business functionality. Current AIdisclaims all liability for any errors, omissions, or inaccuracies in business information provided by verified business owners, and you agree to indemnify Current AI for any claims arising from inaccurate business information you provide.
7. LOCATION SERVICES AND GEOLOCATION
The Services include features that collect and use your precise geolocation data. By enabling location services for the App, you consent to the collection and use of your location data as described in this Section and in our Privacy Notice.
Description of Precise Geolocation Tracking. The App collects precise geolocation data from your mobile device using GPS, Wi-Fi, cellular network triangulation, and other technologies. "Precise geolocation" means location information that identifies your specific geographic coordinates with a high degree of accuracy.
Purposes for Location Data Collection. We collect and use your precise geolocation data for the following purposes: (a) to display local businesses near your current location; (b) to provide real-time business capacity information for nearby businesses; (c) to deliver location-based promotions and offers; (d) to personalize your experience based on your location and location history; (e) to enable the AI chatbot to provide location-relevant recommendations; (f) to improve and develop the Services; and (g) for analytics and aggregate reporting purposes.
Real-Time Location Tracking. Certain features of the Services require real-time location tracking to function properly, including the display of real-time business capacity information and location-based promotions. When you access these features, your location may be tracked continuously or at frequent intervals.
Geolocation Privacy Compliance. Current AI complies with applicable state laws governing the collection and use of precise geolocation data. For detailed information about our geolocation practices, including the frequency of location collection, background versus foreground collection, and your opt-out rights, please see our Privacy Notice at gogetcurrent.io/privacy.
Aggregated Location Tracking and Display. Current AI may aggregate anonymized location data from multiple users to provide real-time information about the popularity or crowdedness of businesses and locations within the App. This aggregated information does not identify individual users.
User Consent and Withdrawal Rights. Your device will request your permission before the App accesses your precise location. You may enable or disable location services for the App at any time through your device settings. Please note that disabling location services may limit or prevent access to certain features of the Services, including local business discovery, real-time capacity information, and location-based promotions.
Background Location Tracking. If you enable background location tracking, the App may collect your location data even when the App is not actively in use. You may disable background location tracking at any time through your device settings. Disabling background location tracking may affect the functionality of certain features, such as location-based notifications.
Location Data Accuracy Disclaimers. Current AI does not guarantee the accuracy, completeness, or reliability of location data or any location-based information provided through the Services. Location data may be affected by environmental factors, device capabilities, network conditions, and other variables. You should not rely solely on location information from the Services for any purpose where accuracy is critical.
8. PROMOTIONS AND OFFERS
The Services display promotions and offers from third-party businesses as well as app-specific promotions from Current AI. This Section governs the terms applicable to promotions and offers displayed through the Services.
Third-Party Business Promotions. The Services may display promotions, discounts, and special offers from third-party businesses ("Third-Party Promotions"). Third-Party Promotions are created and offered by the respective businesses, not by Current AI. Current AI does not endorse, warrant, or guarantee any Third-Party Promotions and is not responsible for the terms, conditions, availability, or fulfillment of any Third-Party Promotions. Any disputes regarding Third-Party Promotions must be resolved directly with the applicable business.
App-Specific Promotions. Current AI may offer promotions, discounts, rewards, or special offers exclusively through the App ("App-Specific Promotions"). App-Specific Promotions are subject to the specific terms and conditions disclosed at the time the promotion is offered, which are incorporated into these Terms by reference.
Redemption Procedures and Limitations. To redeem a promotion, you must follow the redemption procedures specified in the promotion details. Promotions may be subject to limitations, including: (a) one-time use only; (b) limited quantities available; (c) minimum purchase requirements; (d) expiration dates; (e) restrictions on combination with other offers; and (f) other conditions specified in the promotion terms.
Expiration and Modification. Promotions are subject to expiration as specified in the promotion details. Current AI and third-party businesses reserve the right to modify, suspend, or discontinue any promotion at any time, with or without notice, subject to applicable law.
Geographic Restrictions. Certain promotions may be available only in specific geographic areas. The availability of promotions in your area may depend on your location as determined by the App's location services.
Relationship Disclaimers. Current AI's display of Third-Party Promotions does not create any agency, partnership, joint venture, or employment relationship between Current AI and any third-party business. Current AI is not a party to any transaction between you and any third-party business.
Accuracy of Promotional Information. Current AI endeavors to display accurate promotional information but does not warrant or guarantee the accuracy, completeness, or timeliness of any promotional information displayed in the Services. Promotional details, including prices, availability, and terms, are subject to change without notice. In the event of a discrepancy between promotional information displayed in the App and information provided directly by a business, the information provided by the business shall control.
9. AI CHATBOT FEATURES AND LIMITATIONS
The Services include an AI-powered chatbot feature that uses large language model ("LLM") technology to interact with users and provide information, recommendations, and assistance.
Description of AI Chatbot Functionality. The AI chatbot can respond to your questions, provide recommendations for local businesses, assist with finding promotions, and engage in general conversation about topics related to the Services. The AI chatbot is designed to learn from your interactions to provide more personalized responses and recommendations over time.
Automated Profile Updates Based on Chat History. As described in the User Profile and Information section, the AI chatbot may analyze your conversations and automatically update your user profile based on your expressed preferences, interests, and other information you provide during chat interactions. By using the AI chatbot, you consent to these automated profile updates.
Accuracy and Reliability Disclaimers. See Section 14 (Disclaimers and Limitation of Liability).
AI Chatbot Data Processing. For detailed information about how your data is collected and processed by the AI chatbot feature and your rights related thereto, please see our Privacy Notice at gogetcurrent.io/privacy.
User Consent to AI Processing. By using the AI chatbot feature, you consent to: (a) the collection and processing of your chat conversations; (b) the use of your conversations to generate AI responses; (c) the use of your conversations to update your user profile; and (d) the use of de-identified conversation data to improve Current AI's AI systems and Services.
Third-Party AI Service Providers. For information about the third-party AI service providerswe use and how your data may be shared with them, please see our Privacy Notice at gogetcurrent.io/privacy.
AI Data Training. De-identified conversation data from your AI chatbot interactions may be used to train and improve Current AI's AI systems and Services. For more information about how your data may be used for AI training purposes, please see our Privacy Notice.
Automated Decision-Making and Profiling. The AI chatbot and related features may engage in automated decision-making and profiling based on your interactions with the Services. You may have the right to opt out of certain profiling activities under applicable state privacy laws. For more information about automated decision-making, the logic involved, and your rights, please see our Privacy Notice.
Human Escalation. If the AI chatbot cannot adequately address your inquiry, you may contact Current AI customer support at support@gogetcurrent.io to speak with a human representative.
10. USER CONDUCT AND ACCEPTABLE USE
General Standards of Conduct. You agree to use the Services in a manner consistent with all applicable federal, state, and local laws, rules, and regulations. You are solely responsible for your conduct while using the Services and for any content you submit, post, or display through the Services.
Prohibited Activities. You agree not to engage in any of the following prohibited activities in connection with your use of the Services:
(a) Using the Services for any purpose that is unlawful or prohibited by these Terms, or soliciting the performance of any illegal activity or other activity that infringes the rights of Current AI or others;
(b) Uploading, posting, transmitting, or otherwise making available any content that is defamatory, obscene, pornographic, vulgar, offensive, threatening, abusive, hateful, discriminatory, or otherwise objectionable;
(c) Harassing, threatening, stalking, intimidating, or abusing any individual, including other users, business owners, or Current AI personnel;
(d) Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with any person or entity, including Current AI;
(e) Engaging in any fraudulent activity, including creating false or misleading accounts, submitting false business claims, or posting fake reviews or promotional content;
(f) Using the Services to send unsolicited commercial messages, advertisements, or spam, or to engage in commercial solicitation without Current AI's express written permission;
(g) Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code, underlying ideas, algorithms, structure, or organization of the App or any component thereof, except to the extent expressly permitted by applicable law notwithstanding this limitation;
(h) Interfering with or disrupting the Services, servers, or networks connected to the Services, or disobeying any requirements, procedures, policies, or regulations of networks connected to the Services;
(i) Attempting to gain unauthorized access to any portion of the Services, other User Accounts, computer systems, or networks connected to the Services through hacking, password mining, or any other means;
(j) Using any robot, spider, scraper, or other automated means to access the Services or to collect data from the Services for any purpose without Current AI's express written permission;
(k) Uploading, transmitting, or distributing any viruses, worms, Trojan horses, or other malicious code through the Services;
(l) Circumventing, disabling, or otherwise interfering with any security-related features of the Services or features that prevent or restrict use or copying of any content; and
(m) Using the Services in any manner that infringes, misappropriates, or violates any third party's intellectual property rights, rights of publicity or privacy, or other proprietary rights.
Reporting Violations. If you become aware of any violation of these Terms by another user, you may report such violation to Current AI at support@gogetcurrent.io or through the reporting functionality provided within the App. Current AI reserves the right, but has no obligation, to investigate reported violations and to take any action it deems appropriate in response.
Consequences of Violation. Violation of this Section 10 may result in immediate suspension or termination of your User Account, removal of your content, and legal action, as determined by Current AI in its sole discretion.
11. USER-GENERATED CONTENT
User content submitted through the App, including reviews, comments, photos, and other submissions, is subject to these terms. Current AI reserves the right, but has no obligation, to review, edit, or remove any user content that, in Current AI's sole judgment, violates these Terms, our content guidelines, or applicable law.
License Grant. By submitting, posting, uploading, or otherwise making available any content through the Services, including reviews, comments, photographs, text, and other materials ("User Content"), you grant to Current AI a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media or distribution method now known or hereafter developed, in connection with the Services and Current AI's business operations. This license continues even if you stop using the Services or terminate your User Account.
User Representations Regarding Content. You represent and warrant that: (a) you own all rights in and to your User Content or have obtained all necessary permissions, licenses, and consents to grant the foregoing license; (b) your User Content does not violate, misappropriate, or infringe any third party's intellectual property rights, rights of publicity or privacy, or other proprietary rights; (c) your User Content is accurate and not misleading; and (d) your User Content does not violate these Terms, any applicable law, or any third party's rights.
User Responsibility for Content Accuracy. You are solely responsible for the accuracy, completeness, and legality of all User Content you submit. Current AI does not endorse, verify, or assume any responsibility for User Content posted by users.
Content Moderation and Removal. Current AI reserves the right, but has no obligation, to monitor, review, edit, or remove any User Content that, in Current AI's sole judgment: (a) violates these Terms or Current AI's content guidelines; (b) is offensive, obscene, defamatory, threatening, harassing, or otherwise objectionable; (c) infringes or violates any third party's rights; (d) is fraudulent, misleading, or deceptive; or (e) may expose Current AI to legal liability. Current AI's failure to remove any content does not constitute a waiver of Current AI's right to do so in the future or an endorsement of such content.
DMCA Compliance. Current AI respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that any user content infringes your copyright, please submit a DMCA notice to our designated Copyright Agent as described in Section 20 of these Terms.
12. INTELLECTUAL PROPERTY RIGHTS
Ownership of App Content. The App and the Services, and all content, features, and functionality thereof (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement), are owned by Current AI, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Trademarks and Trade Dress. Current AI, the Current AI logo, Current, and all related names, logos, product and service names, designs, and slogans are trademarks of Current AI or its affiliates or licensors. You may not use such marks without the prior written permission of Current AI. All other names, logos, product and service names, designs, and slogans appearing on the Services are the trademarks of their respective owners.
Limited License to Users. Subject to your compliance with these Terms, Current AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes. This license does not include: (a) any resale or commercial use of the Services or their contents; (b) any collection and use of any product listings, descriptions, prices, or other content; (c) any derivative use of the Services or their contents; (d) any downloading or copying of account information for the benefit of another merchant; or (e) any use of data mining, robots, or similar data gathering and extraction tools.
Restrictions. You shall not: (a) reproduce, distribute, publicly display, publicly perform, or create derivative works of the Services or any content therein; (b) copy, modify, adapt, or translate any portion of the Services; (c) reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the App; (d) remove, obscure, or alter any copyright, trademark, or other proprietary rights notices from the Services; (e) use any meta tags or other hidden text or metadata utilizing a Current AI trademark, logo, URL, or product name without Current AI's express written consent; or (f) frame or mirror any portion of the Services.
Third-Party Content Acknowledgments. The Services may contain content owned by or licensed from third parties. Current AI respects the intellectual property rights of third parties and requires that you do the same. Third-party content is provided for your information only and remains the property of its respective owners.
Feedback and Suggestions. If you provide Current AI with any feedback, suggestions, ideas, improvements, or other input regarding the Services ("Feedback"), you hereby assign to Current AI all right, title, and interest in and to such Feedback, and Current AI shall be free to use, disclose, reproduce, license, distribute, and otherwise commercialize the Feedback as it sees fit, without obligation or restriction of any kind.
13. THIRD-PARTY CONTENT AND SERVICES
The Services display information about third-party businesses, including business names, addresses, hours of operation, contact information, menus, services, and other details. This information is obtained from various sources, including the businesses themselves, public databases, and user submissions. Current AI does not verify the accuracy of third-party business information and does not endorse or recommend any third-party business.
Real-Time Capacity Information Disclaimers. The Services may display real-time information regarding the current capacity, crowdedness, or wait times at third-party businesses. This information is estimated based on various data sources and may not be accurate or current. Current AI DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, OR TIMELINESS OF REAL-TIME CAPACITY INFORMATION. You should verify capacity and wait time information directly with the business before visiting.
Third-Party Service Integrations. The Services may integrate with or provide access to third-party services, applications, or platforms (collectively, "Third-Party Services"), including social media platforms, mapping services, payment processors, and other service providers. YOU ACKNOWLEDGE THAT CURRENT AI HAS SET ITS FEES AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE LIMITATIONS OF LIABILITY AND DISCLAIMERS OF WARRANTIES AND DAMAGES SET FORTH HEREIN, AND THAT THE SAME FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES.
15. INDEMNIFICATION
You agree to indemnify and hold Current AI, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, directors, and contractors (the “Affiliated Parties”) harmless from any breach of these Terms by you. You agree that the Affiliated Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify the Affiliated Parties against all resulting loss, damages, judgments, awards, costs, expenses, and attorneys' fees of the Affiliated Parties in connection therewith.
You will also indemnify and hold the Affiliated Parties harmless from and against any claims brought by third parties arising out of your use of the App and/or Services.
You agree to defend, indemnify, and hold harmless Current AI, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the "Indemnified Parties") from and against any and all claims, demands, actions, causes of action, suits, proceedings, losses, damages, costs, expenses, and liabilities (including reasonable attorneys' fees and costs) arising out of or relating to:
(a) your access to or use of the App or the Services;
(b) your breach of these Terms, the EULA, or any representation, warranty, or covenant contained therein;
(c) your violation of any applicable law, rule, or regulation;
(d) your User Content, including any claim that your User Content infringes, misappropriates, or violates any third party's intellectual property rights, rights of publicity or privacy, or other proprietary rights;
(e) any content you submit, post, or transmit through the App;
(f) your use of the Business Owner Claim functionality, including any inaccurate or misleading business information you provide;
(g) any dispute between you and any third party, including any third-party business; and
(h) any other matter for which you are responsible under these Terms.
Scope of Covered Claims. Your indemnification obligations under this Section extend to all claims, whether based in contract, tort, strict liability, or any other theory of liability, and whether arising before or after termination of these Terms.
Notice and Cooperation. Current AI shall provide you with prompt written notice of any claim subject to indemnification under this Section; provided, however, that Current AI's failure to provide such notice shall not relieve you of your indemnification obligations except to the extent that such failure materially prejudices your ability to defend such claim. You agree to cooperate fully with Current AI in the defense of any indemnified claim.
Right to Control Defense. Current AI reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with Current AI's defense of such claims. You shall not settle any claim subject to indemnification without Current AI's prior written consent.
16. TERM AND TERMINATION
Term of Agreement. These Terms are effective as of the date you first access or use the Services and shall continue in full force and effect until terminated in accordance with this Section. For users with paid subscriptions, these Terms shall remain in effect for the duration of your subscription period and any renewal periods, unless earlier terminated as provided herein.
User Termination Rights. You may terminate your User Account and your agreement to these Terms at any time by: (a) deleting the App from your device; (b) requesting account deletion through the App settings; or (c) contacting Current AI at support@gogetcurrent.io. If you have an active paid subscription, termination of your User Account will also cancel your subscription, but you will not receive a refund for any unused portion of your current billing period.
Current AI Termination Rights. Current AI may suspend or terminate your User Account and access to the Services at any time, with or without cause, and with or without notice. Without limiting the foregoing, Current AI may suspend or terminate your access if: (a) you breach these Terms; (b) Current AI is required to do so by law; (c) Current AI decides to discontinue the Services; or (d) Current AI determines, in its sole discretion, that your continued use poses a risk to Current AI, other users, or third parties.
Effect of Termination. Upon termination of your User Account: (a) your right to access and use the Services will immediately cease; (b) Current AI may delete your User Account and associated data, subject to any legal retention requirements; (c) you will lose access to any unredeemed promotions or rewards; and (d) any provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
Account Suspension. Current AI may suspend your access to all or part of the Services, with or without notice, pending investigation of suspected violations of these Terms. During any suspension, you will not be able to access your User Account or use the affected Services.
17. DISPUTE RESOLUTION
Governing Law; Venue. This Section governs the rules, procedures, and applicable law for any legal claims or disputes arising out of or in any way related to your use of the App, these Terms, the EULA, or the Privacy Notice and Policy (a “Dispute”).
With respect to any Dispute not covered by the Arbitration provisions of these Terms, in the event any litigation commences between the parties, you agree that the Dispute shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions, and that jurisdiction and venue shall properly lie only in the state and federal courts of Mecklenburg County, State of North Carolina.
Mandatory Negotiation. No less than thirty (30) days before initiating any formal dispute resolution proceeding, you agree to first contact Current AI at support@gogetcurrent.io and attempt to resolve the dispute informally. You agree that you will include in that initial notice a description of the Dispute in reasonable detail and what relief you are requesting. You agree to work with Current AI, with both parties acting in good faith, to resolve the dispute through directnegotiations. If the dispute is not resolved within thirty (30) days of your initial notice, either party may proceed with mediation.
Mandatory Mediation. You agree to participate in non-binding mediation administered pursuant to the American Arbitration Association (“AAA”) Consumer Mediation Rules. Unless otherwise agreed in writing, the mediation will occur in Mecklenburg County, State of North Carolina, and will be completed within 90 days of the initial request for mediation. The parties will share the mediator’s fees and expenses equally, and each will bear their own costs and attorney’s fees.
At no time before the resolution of the mediation set forth above shall either side initiate an arbitration, litigation, or another proceeding related to these Terms except to pursue a provisional remedy that is authorized by law, by the AAA Consumer Mediation Rules, or by agreement of the parties. This limitation does not apply to actions taken by Current AI if you refuse to comply with this Section.
MANDATORY, BINDING ARBITRATION.
EXCEPT AS PROVIDED HEREIN, ANY DISPUTE THAT IS NOT RESOLVED THROUGH NEGOTIATION OR MEDIATION SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AAA UNDER ITS AI-LED ARBITRATION OR ITS CONSUMER ARBITRATION RULES & PROCEDURES.
The arbitration will be conducted by a single arbitrator. The arbitrator will be selected in accordance with AAA rules and procedures.
The arbitration will be conducted in Mecklenburg County, State of North Carolina, and these Terms and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of North Carolina, exclusive of conflict or choice of law rules. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Confidentiality of the Proceedings. The parties shall maintain the confidential nature of the arbitration, including the proceeding and the award except as may be necessary to prepare for or conduct the arbitration hearing on the merits or in connection with a court application for a preliminary remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or judicial decision.
Exception to Arbitration. Notwithstanding the provisions of this Section, either party may bring an individual action in Small Claims Court in Mecklenburg County, State of North Carolina, for any Dispute that is within that court’s jurisdiction and for which the party initiating the claim is not seeking recovery in excess of five thousand ($5,000) dollars.
Prevailing Party. In any action to enforce these Terms, the prevailing party will be entitled to recover its legal expenses, including reasonable attorneys’ fees, legal assistants’ fees, costs and expenses from the non-prevailing party of all court costs (including bankruptcy proceedings and appeals) in addition to any other relief to which the party is entitled. Any cause of action brought by you against Current AI or its officers, partners, directors, managers, members, shareholders, distributors, affiliates, subsidiaries, sponsors, advertisers, licensors, employees, agents, representatives or independent contractors, must be instituted within one year after the cause of action arises or be deemed forever waived and barred.
Limitation of Claims. YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE APP, ANY SERVICE PROVIDED BY THE APP, OR THE TERMS OF USE MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.
Class and Representative Action Waiver. To the fullest extent permitted by law, you agree that all proceedings related to any Disputes, regardless of venue or forum, shall be conducted only on an individual basis and not in a class, consolidated, collective, private attorney general, or representative action. Relief for any Disputes may only be awarded in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by the Dispute.
Arbitration Opt-Out. Where required by law, you may opt out of the arbitration agreement contained in these Terms by sending written notice to Current AI at support@gogetcurrent.iowithin thirty (30) days after you first agree to these Terms. Your opt-out notice must include your name, address, email address, phone number, and a clear statement that you wish to opt out of arbitration. If you opt out, you and Current AI may pursue claims against each other in court, subject to the other provisions of these Terms.
Small Claims Court Exception. Notwithstanding the arbitration provisions, either party may bring an individual action in small claims court for disputes within the court's jurisdiction, provided that the action is not removed or appealed to a court of general jurisdiction.
Injunctive Relief Carve-Out. Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.
Notice Requirements for Claims. Any claim or dispute arising out of or relating to these Terms must be filed within one (1) year after the claim arose, or the claim is permanently barred. Before filing any claim, you must send written notice to Current AI at 1711 Commonwealth Ave., #217 Charlotte, 28205 describing the nature of the claim, the relief sought, and your contact information.
18. GENERAL PROVISIONS
Entire Agreement. These Terms, together with the Privacy Notice and Policy, the EULA, and any other policies incorporated by reference (collectively, the “User Agreements”), constitute the entire agreement between you and Current AI regarding the Services, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Current AI with respect to the App and the Services. In the event of any conflict among the User Agreements: (a) the EULA shall govern solely with respect to the licensing of the App; (b) these Terms shall govern all other matters relating to your use of the App and the Services; and (c) the Privacy Notice and Policy shall govern with respect to the collection, use, disclosure, and protection of Personal Information.
Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the App. Current AI may revise these Terms at any time by updating these Terms and posting it on the App. Accordingly, you should visit the App and review the Terms of Use periodically to determine if any changes have been made. Your continued use of the Appafter any changes have been made to the Terms of Use signifies and confirms your acceptance of any such changes or amendments to the Terms of Use.
Severability. If any provision of these Terms shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Waiver. The failure of Current AI to exercise or enforce any right or provision of these Termsshall not operate as a waiver of such right or provision. Any waiver of these Terms by Current AImust be in writing and signed by an authorized representative of Current AI.
Assignment. Current AI may assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without notice. Subject to the preceding, these Terms bind and inure to the benefit of the parties and their permitted successors and assigns.
Except as provided herein, no assignment, transfer, or delegation of any rights or obligations under these Terms shall be made without the prior written consent of the parties. Any attempted assignment or transfer in violation of this Section is void.
Force Majeure. Current AI shall not be liable for any failure or delay in performing its obligations under these Terms, including providing access to the App or Services, where such failure or delay results from any cause beyond Current AI's reasonable control, including but not limited to: (a) acts of God, flood, fire, earthquake, pandemic, epidemic, or other natural disaster; (b) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest; (c) government order, law, or actions; (d) embargoes, sanctions, or export or import restrictions; (e) national or regional emergency; (f) strikes, labor stoppages, or lockouts; (g) power outages, telecommunications failures, or Internet service provider failures; (h) cyberattacks, ransomware attacks, denial-of-service attacks, or other malicious acts targeting Current AI's systems or infrastructure; or (i) failure of third-party service providers or vendors (each, a "Force Majeure Event").
Notices.
To Current AI. All notices, requests, demands, and other communications required or permitted under these Terms to Current AI shall be in writing and shall be deemed delivered: (a) upon receipt if delivered personally; (b) upon receipt if sent by certified or registered mail, return receipt requested; (c) three (3) business days after deposit with a nationally recognized overnight courier; or (d) upon confirmation of receipt if sent by email. To You. Current AI may provide notices to you by: (a) posting on the App or Services; (b) sending an email to the email address associated with your User Account; or (c) any other method Current AI deems appropriate. Notices posted on the App or Services shall be deemed delivered upon posting. Notices sent by email shall be deemed delivered upon sending.
Change of Address. Either party may change its address for notices by providing written notice to the other party in accordance with this Section.
Consent to Electronic Notices. You consent to receive all notices, agreements, disclosures, and other communications electronically, including via email or by posting on the App or Services. You agree that such electronic communications satisfy any legal requirement that such communications be in writing.
Relationship of the Parties. Nothing contained in these Terms or your use of the App shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
Third-Party Beneficiaries. Except as otherwise expressly provided herein, these Terms are intended solely for the benefit of Current AI and you, and nothing in these Terms shall be construed to create any third-party beneficiary rights in any person or entity. Notwithstanding the foregoing, Apple Inc. and Google LLC, as applicable, shall be third-party beneficiaries of these Terms with respect to users who access the App through the Apple App Store or Google Play Store, respectively, and such third parties shall have the right to enforce these Terms against you as a third-party beneficiary thereof.
Accessibility. We endeavor to design our Services to reach all our users. To that end, our App and Services are designed to support screen readers, voice control, keyboard navigation, and other assistive technologies. We have taken steps to clearly label, describe, logically arrange, and provide an appropriately sized click or tap area for interactive elements.
We welcome your feedback on the accessibility of the App. If you have any questions or experience any difficulties accessing the Services, please contact us via the contact information in Section 20, below.
19. MODIFICATION
Current AI reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the App or any service provided by the App (or any part thereof) with or without notice. You agree that Current AI will not be liable to you or any third party for any modification, suspension or discontinuance of the App or any service.
If Current AI makes material changes to these Terms, Current AI will provide notice to you by: (a) posting the updated Terms in the App with a new "Last Modified" date; (b) sending an email to the email address associated with your User Account; or (c) displaying a notice within the App.
Continued Use as Acceptance. Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and may terminate your User Account as described herein.
Effective Date of Changes. Unless otherwise specified, modifications to these Terms will be effective immediately upon posting. For material changes that may adversely affect your rights, Current AI will endeavor to provide at least thirty (30) days' notice before the changes become effective.
Access to Prior Versions. You may request copies of prior versions of these Terms by contacting Current AI at support@gogetcurrent.io.
